ARTICLE 1.1 – SELLER

This contract has been prepared based on the obligation to make a contract for sales made over the internet in accordance with the Regulation on the Application Procedures and Principles of Distance Contracts published in the Official Gazette dated 13.06.2003 and numbered 25137, and its articles are as follows.
ARTICLE 1 - SUBJECT
The subject of this contract covers the rights and obligations of the parties in accordance with the provisions of the Law No. 4077 on the Protection of Consumers - Regulation on the Application Principles and Procedures of Distance Contracts, regarding the sale and delivery of the product, the characteristics and sales price of which are specified below, sold by the SELLER to the BUYER.

ARTICLE 2.2 - BUYER INFORMATION
The person who becomes a member of the www.elsacrystal.com shopping site as a customer. The address and contact information used when registering are taken as basis.
ARTICLE 3 - PRODUCT INFORMATION SUBJECT TO THE CONTRACT
The type, quantity, brand/model, colour, number, sales price and payment method of the Goods/Product/Service consist of the information at the time the order is finalised.
ARTICLE 4 - GENERAL PROVISIONS
4.1- BUYER declares that he/she has read and is informed about the basic characteristics, sales price and payment method of the product or products subject to the contract specified in Article 3 and all preliminary information regarding delivery and has given the necessary confirmation electronically.
4.2 - The product or products subject to the contract shall be delivered to the BUYER or the person/organization at the address indicated by the BUYER within the period specified in the preliminary information, depending on the distance of the BUYER's place of residence, provided that the legal 30-day period is not exceeded. This period may be extended by a maximum of 10 days, provided that the BUYER is notified in advance.
4.3 - If the product subject to the contract is to be delivered to a person/organization other than the BUYER, www.elsacrystal.com cannot be held responsible if the person/organization to whom the product is to be delivered does not accept the delivery.
4.4 – www.elsacrystal.com is responsible for the delivery of the contractual product in a sound and complete manner, in accordance with the specifications specified in the order, and with warranty documents and user manuals, if any.
4.5 - For the delivery of the contractual product, it is required that the signed copy of this contract be delivered to www.elsacrystal.com and the price be paid using the payment method preferred by the BUYER. If the product price is not paid or is cancelled in the bank records for any reason, www.elsacrystal.com is deemed to be relieved of its obligation to deliver the product.
4.6- If the relevant bank or financial institution does not pay the price of the product to www.elsacrystal.com due to the unfair or illegal use of the BUYER's credit card by unauthorized persons for reasons not caused by the BUYER's fault after the delivery of the product, the product must be sent to www.elsacrystal.com within 3 days, provided that it has been delivered to the BUYER. In this case, the shipping costs belong to the BUYER.
4.7- If www.elsacrystal.com cannot deliver the contracted product within the specified time due to force majeure or extraordinary circumstances such as adverse weather conditions or interruption of transportation, it is obliged to notify the BUYER. In this case, the BUYER may exercise one of the following rights: cancellation of the order, replacement of the contracted product with a similar one, if any, and/or postponement of the delivery period until the impeding situation is eliminated. In the event that the BUYER cancels the order, the amount paid by the BUYER shall be paid to the BUYER in cash and in a single transaction within 15 business days.
4.8- Defective or broken products sold with or without a warranty certificate can be sent to www.elsacrystal.com for the necessary repairs under warranty conditions, in which case the shipping costs will be covered by www.elsacrystal.com.
4.9- In the purchases made by non-consumer BUYERS for one or more products, even if the order has been made and the amount has been taken from the BUYER's credit card (or other payment methods), the SELLER has the right to cancel the contract (order) or a part of the order before the delivery without stating any reason. It can refund the paid amount to the credit card (or account) in the same way as the BUYER paid it. The transfer of the refunded amount to the BUYER's account is the responsibility of the institution that issued the card/to which the account belongs, and the SELLER has no responsibility for any delays that may occur.
4.10- This contract becomes valid after it is signed by the BUYER and delivered to www.elsacrystal.com by phone or mail, or after the relevant contract checkbox is checked on www.elsacrystal.com and the order is completed.
ARTICLE 5 -
RIGHT OF WITHDRAWAL The BUYER has the right of withdrawal within (14) days from the delivery of the contractual product to him/her or to the person/organization at the address he/she has indicated. In order to exercise the right of withdrawal, it is required that a notification is made to www.elsacrystal.com by fax, e-mail or telephone within this period and that the product has not been used within the framework of the provisions of the relevant article.
In case of exercising this right, it is mandatory to return the copy of the cargo delivery report stating that the product delivered to the 3rd party or the BUYER was sent to www.elsacrystal.com and the original invoice.
The product price will be refunded to the BUYER within 15 days following the receipt of these documents. If the original invoice is not sent, VAT and other legal obligations, if any, cannot be refunded.
The shipping cost of the product returned due to the right of withdrawal is covered by the BUYER. The right of withdrawal cannot be exercised for products that cannot be returned due to their nature, single-use products, products that deteriorate quickly or products that have expired.
In addition, the consumer cannot exercise the right of withdrawal for goods that are produced in accordance with the consumer's special requests and demands or that have been personalized by making changes or additions. If the payment is made by credit card or a similar payment card, the consumer may request that the payment transaction be cancelled on the grounds that the card was used without his/her consent and in an unlawful manner.
In this case, the card issuing institution shall refund the payment amount to the consumer within 15 working days from the notification of the objection. In the implementation of this contract, Consumer Arbitration Committees and Consumer Courts at the location of www.elsacrystal.com shall have jurisdiction up to the value declared by the Ministry of Industry and Trade. In the event of the conclusion of the order, the BUYER shall be deemed to have accepted all the terms of this contract.
